Please read the following terms carefully. By completing your reservation, you are deemed to agree to all terms below.

Farm Picking Information

Free tasting of sweet tangerines is available at Sunmist Estate.

Takeaway Rates: Tangerine $2.5/lb; Meyer Lemon $2.5/lb.

Blueberries and avocados are sold by box and bag.

Picking bags are provided on-site. You may bring your own gloves, picking shears, sun hat, sunscreen, and hand sanitizer as needed.

After your reservation is confirmed, a confirmation email will be sent automatically to your registered email address. The email will also include the official website link of this liability waiver for your permanent reference and record.

Entry & Compliance Commitment

In consideration for being granted entry to the premises of Sunmist Estate (a division of Sunmist Fruit), located at 26700 Avenida Del Oro, Temecula, CA 92590 (33°29'47.9"N 117°11'52.7"W) and 0 Via Escalón, Temecula, CA 92590 (33.50336632, -117.2746697) (hereinafter referred to as “the Farm”) for the purpose of fruit picking, harvesting and collection, I, the undersigned, hereby agree as follows:

(i) To comply with all rules, regulations and guidelines formulated by the Farm, and I acknowledge receipt and full understanding of such provisions;

(ii) To exercise reasonable care and caution to avoid personal injury to myself or others, and to prevent damage to the Farm’s trees, vegetation and property;

(iii) To use all fruit pickers and farm equipment in a safe and proper manner;

(iv) To release the Farm from any liability for loss, injury or harm that I may sustain in connection with picking, harvesting or consuming fruit on the Farm premises.

Inherent Risk Disclosure

I acknowledge and fully understand that inherent safety risks exist when entering the Farm for fruit picking and harvesting.

Such risks include but are not limited to: injury caused by broken or falling branches or falling fruit; insect bites and stings; slips, trips or falls on uneven ground, tree roots or scattered debris; falls from ladders or scaffolding; risk of foodborne illness; scratches and abrasions from thorns, brambles, burs, barbed wire and picking tools; severe sunburn; and heat exhaustion.

I understand that the Farm does not provide any safety guarantee or warranty. I voluntarily assume all risks of loss, injury or illness arising from fruit picking, harvesting, collection and consumption on the Farm property.

Ladder Usage Option

(Please initial your selected option)

_______ I will not use a ladder for fruit picking. For out-of-reach fruit, I will use a picking pole, net or extended fruit picker only.

_______ I choose to use a ladder for fruit picking and assume all associated risks voluntarily.

Liability Release & Waiver (Key Terms)

In consideration of entry permission granted by the Farm, I irrevocably agree not to file any claim, lawsuit or legal action against the Farm for any injury, loss or illness suffered during fruit picking or consumption, including incidents arising from the Farm’s ordinary or gross negligence.

I agree to indemnify and hold harmless the Farm from all claims, demands or liabilities raised by myself or any third party relating to injury, loss or illness occurring during fruit picking or consumption on the Farm premises.

This waiver constitutes a full and final release of all claims, causes of action and legal rights against Sunmist Estate for any reason related to my entry and activities on the Farm property, now and in the future.

General Terms

The Farm reserves the right to revoke entry and picking permission at any time, for any reason, before or after this agreement is acknowledged.
Any dispute arising between the Farm and myself shall first be resolved through friendly negotiation or confidential mediation.
If any clause of this agreement is deemed invalid by a court of competent jurisdiction, the remaining clauses shall remain fully enforceable. This agreement shall be binding on my heirs, legal representatives and successors in interest.
I have carefully read, fully understood and voluntarily accepted all terms of this liability waiver. I acknowledge its legal binding effect.
