FIELD TRIP WAIVER AND INDEMNITY AGREEMENT

PARTIES
This Agreement is entered into between:
A. THE GROUP: The Sponsoring Institution/School/Organization/Family (and its Authorized Representative, acting on behalf of all individuals participating in this field trip, including but not limited to students, teachers, chaperones, and family members) (hereafter, "The Group"); and and B. Sunmist Fruit, doing business as SUNMIST ESTATE (hereafter, the "Releasees").
1. ACKNOWLEDGMENT AND ASSUMPTION OF RISKS
The Group, by its Authorized Representative signing this agreement, acknowledges that all Participants (including minor participants) engaging in activities at Sunmist Estate (the "Activity") are subject to inherent risks.
These risks include, but are not limited to: a. Physical Injury: Slips, trips, and falls on uneven or wet ground, sprains, fractures, cuts, or other physical injuries resulting from movement or interaction with equipment and natural surroundings. b. Environmental Risks: Exposure to insects, allergens (pollen, plants, food items), sun exposure, adverse weather conditions, and contact with natural flora and fauna. c. Property and Illness Risk: Risk of damage to personal property or exposure to communicable illnesses, including viruses and bacteria.
The Group, on behalf of all Participants, voluntarily accepts and assumes all risks, both known and unknown, associated with the Activity.
2. WAIVER AND RELEASE OF LIABILITY
In consideration of The Group and its Participants being permitted to engage in the Activity, The Group, acting on behalf of all Participants (including minor participants), hereby releases, discharges, and covenants not to sue Sunmist Estate, its owners, directors, officers, employees, agents, and volunteers (collectively, the "Releasees"), from any and all liability, claims, demands, losses, or damages, on account of injury, death, or property damage, whether caused by the negligence of the Releasees or otherwise, that any Participant may incur during participation in the Activity.
This release includes claims based on the negligence of The Releasees, but not claims based on gross negligence or willful misconduct.
3. INDEMNIFICATION
The Group agrees to indemnify, defend, and hold harmless the Releasees from and against any and all losses, liabilities, damages, costs, or expenses (including reasonable attorney's fees) they may incur as a result of any claim, suit, or demand made by or on behalf of any Participant, or by any third party, arising out of or in any way related to The Group's or its Participants' involvement in the Activity.
4. MEDICAL AUTHORIZATION
The Group certifies that it has established and communicated clear emergency medical procedures for all Participants (especially minors). In the event of an emergency, The Group authorizes The Sunmist Estate staff to assist in securing and authorizing necessary emergency medical treatment. The Group understands and agrees that The Group or its representative is responsible for all costs of such medical treatment and transportation. The Group agrees to notify The Sunmist Estate of any known specific medical conditions or allergies prior to the trip.
5. BINDING EFFECT
The Group understands that this Waiver of Liability and Indemnity Agreement shall be binding upon The Group, its successors, legal representatives, and assigns.
